SHOP & ESTABLISHMENTS REGISTRATION

Our Associates help its clients in getting license under Shops & Establishment Act.  Through this enactment appropriate govt. has put mandatory conditions for the every business establishment throughout India, either with or without employees, to get their business registered with the office of labour commissioner /Department of Labour with in 30 days from the date of starting of business establishment by submitting few information related to number of persons/young persons working, time of working hours, lunch timing, closing hours, weekly holyday. The very purpose of this enactment to bring into existence is to cast responsibilities of employers and rights of workers in unorganized sectors that to they must strictly adhere to national and religious leaves, setting regulations for the recruitment of children, women, maternity leaves, sick and casual leaves regulations for recruitment and termination of services, annual holiday, upkeep of records & registers and name of manager along with documents related to identity of business & employer, proof of address of business, pay, deduction etc,. This enactment classifies the responsibilities for employers and offers a series of rights to their employees. This certificate so granted by Dept. of labour is further required to be renewed every at the end of financial year. Any business establishment after getting registered with the labour department, such certificate/license could utilize for several purposes e.g. opening of bank account as a proof of address and with other governmental authorities or private entities for any purposes being accepted. The business enterprises further required to maintain register related to workers properly.

IMPORT EXPORT CODE

Import Export (IE) Code is 10 digit code issued by Director General of Foreign Trade (DGFT) Ministry of Commerce (GOI) on one time basis (not renewable), which mandatorily required for identification of exporter (who export goods from India to abroad) or Importer (who import goods in India from any foreign country) by Govt. authorities. It help in introducing your product and business at Global Market, eligible to getting benefits like Merchandise Export from India Scheme (MEIS) or Service Export from India Scheme (SEIS).  It can be obtained by any person including Individual, partnership firm, Private/Public Limited Companies or any other legal entities irrespective of your size of business or business set up. In order to obtain IE Code, Our Associates help you to obtain Import Export Code (IEC) by filing application on your behalf with the Director General of Foreign Trade (DGFT) and it usually being granted within 10-15 days by the appropriate govt./department concern. Simply you need to provide us few documents like PAN (mandatory), Identity, address proof, constitution of business and cancelled Cheque or any other like substitute documents as may be required by appropriate govt.

TDS RETURN

Our Associates also helping our clients, in filing their TDS Return (Tax Deduction at Source), which otherwise required to be filed on quarterly basis. An employer or any other person as defined under Income Tax Act, making payment to any other person required to deduct TDS at the rate as may be specified, before making payment to other person, TDS so deducted further required to make payment in following month within prescribed due date to the government treasury but TDS statement/return required to be filed on quarterly basis failing which late fee, interest and penalty may be imposed. In order to deduct TDS or filing return TAN/PAN number mandatorily required of deductor. The payment can be in the nature of e.g. payment of salary, commission, brokerage, winning of lottery, interest payment etc. We collecting your data related to deduction of TDS and further deposit of such TDS to govt. treasury, prepare the TDS return  and adherence to compliance with regulations file it. Few documents which we required is TAN, PAN, last TDS filing details, period for which TDS has to be filed, date of incorporation of your business, transaction details for filing TDS return, name of the entity and capacity like proprietorship/partnership/company etc.

 

Professional Tax Registration

Our Associates help our clients in getting Professional Tax Registration Number. Professional Tax is kinds of state level Tax which applies to salaried employees and professionals, including chartered accountants, lawyers, and doctors etc.  The professional Tax Registration Number is usually being issued within 15 days (approx) from the date of application but very from state to state practices. The responsibility to obtain professional tax registration number is on employer, business owner/firm irrespective of their field/sector like pharmaceuticals, finance and several other sectors etc., to deduct professional tax and make payment of the same, subject to certain exception like individual with over 65 years of age, parents of permanent disability of their children, disable person, members of armed forces and few others as specified by appropriate govt. The rates of professional tax, filing of return for the same is very from state to state. Few states charging fixed rate of professional tax. Although deduction against payment of professional tax available under the law for the time being in force yet if any person liable to make payment of professional tax and failed to comply the same, then he may be liable to huge penalty for non compliance. If you have several branches of your business in different states in India, then you will have to obtain separate professional tax registration number for making payment of tax. The mainly following documents are required for getting professional tax registration.

  1. Certificate of Incorporation, including MOA & AOA / LLP Agreement.
  1. PAN card of Company/LLP which is attested by the company director
  2. Place of business proof along with a NOC from the owner of the premises
  3. Bank account of the company including bank statement and cancelled cheque.
  4. Passport size photographs, address and identity proof from all the directors
  5. Board resolution or in other words, the statement of consent by the partners.
  6. Shop and establishment certificate
  7. Salary register and attendance register
  8. Any other documents as may be required by authority concerned.

 

TRADEMARKS REGISTRATION

Our Associate help our clients in getting Trademark Registration. Whether you are Individual, partnership firm, companies, or any other business entity, the only way to protect your business name, logo, word, slogan, photograph, color combination etc., from getting copied/imitation by any others/ business entities, by getting registered your business name with the Trademarks authority concern. A Trademark is a unique identity e.g. word, slogan, photograph, logo, color combination or graphics etc. that makes your product or service different from the others. The registration of Trademark is a process through which you can protect your business logo, name, word, slogan from imitation/copy. As per the Trademark Act, it can be registered by making application to the Controller General of Patents, Designs and Trademarks, Ministry of Industry and commerce, (GOI). Usually, after making application with the department, it further takes 24 Months (2 years approx.) to grant you registration but immediately after making application, you can use TM with your business name for which you made the application. After grant of registration of Trademarks you can use ® symbol with your registered business name, which shall be valid for 10 years can be re-registered for further 10 years. After registration of trademarks, if any person/business copying registered trademarks, then you have the option to sue them from further using the same and can also claim damages & compensation for any loss caused to you by filing suit any them as may be advised.

COPYRIGHTS REGISTRATION

Our Associates also help our clients in getting registered Copyright of your literary, audio-visual, works, which you have created your own artistic work e.g. books, scripts, even software, music, movies, photographs, software, manuscripts, etc. The registration of copyright, give you complete peace of mind from any kind of reproduction of copies for commercial uses by others, without your lawful authority. In case of any disputes over copyright, you can knock on the door of the court over your original work. But this option you could only exercise if you have registered copyright with the registrar of copyright within the period of five years from the dates of creation. It is to be noted that registration of copyright is voluntary, not mandatory.
